{"id":680,"date":"2022-12-13T16:23:49","date_gmt":"2022-12-13T15:23:49","guid":{"rendered":"https:\/\/ambottawa.esteri.it\/?page_id=680"},"modified":"2025-06-11T21:22:33","modified_gmt":"2025-06-11T19:22:33","slug":"power-of-attorney","status":"publish","type":"page","link":"https:\/\/ambottawa.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/servizi-notarili\/power-of-attorney\/","title":{"rendered":"Power of Attorney"},"content":{"rendered":"<p><strong>Power of Attorney<\/strong><\/p>\n<p>A Power of Attorney (POA) is a legal instrument giving one person (the agent) the power to act on behalf of another person (the principal) in private affairs, business or other legal matters (for example: sell or purchase, administer, make donations, accept donations, create or dissolve companies, request the publication of marriage banns, etc.)<\/p>\n<p>There are two types of Power of Attorney:<\/p>\n<ul>\n<li><strong>General POA<\/strong>: the principal entrusts to the agent the management of all his\/her\/their affairs, both present and future. A general POA is granted for an indefinite period of time.<\/li>\n<li><strong>Special POA<\/strong>: the principal entrusts the agent with the management of a specific part of his\/her\/their affairs. The Special POA ceases in effect upon the conclusion of the task for which the POA was issued.<\/li>\n<\/ul>\n<p>Both types of POAs may be revoked.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>For Italian citizens only<\/strong><\/p>\n<p>If you need to draft a POA with validity in Italy, please send an email to\u00a0<a href=\"mailto:consolare.ottawa@esteri.it\">consolare.ottawa@esteri.it<\/a> with the following information: name and surname of the principal, date and place of birth, current address, and type of POA required.<\/p>\n<p>The Consular Office will reply by providing further instructions depending on the type of power of attorney and by scheduling an appointment date and time for the in-person signature of the POA. Please bring a valid identification document with you.<\/p>\n<p>The fee for the service is listed\u00a0<a href=\"https:\/\/ambottawa.esteri.it\/it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/altri-servizi\/albo-consolare\/tabella-diritti-consolari\/\">here<\/a>.<\/p>\n<p><em>(art. 17A for a general POA; art. 18A for a special POA, art.24 signature certification for a holograph POA).<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><strong>For citizens of other countries (including Italy)<\/strong><\/p>\n<p>If you need to draft a POA with validity in Italy, you must do so with a Canadian lawyer\/notary.<\/p>\n<p>Following the entry into force in Canada of the\u00a0<strong>Hague Convention on the Apostille (January 11, 2024)<\/strong>,\u00a0<strong>all notarial deeds to be enforced in Italy<\/strong> (general and special powers of attorney and other notarial deeds) drawn up by notaries public or lawyers\u00a0<strong>MUST be APOSTILLED.<\/strong><\/p>\n<p>Apostille to be requested to the\u00a0<a href=\"https:\/\/www.ontario.ca\/page\/authenticate-document-use-outside-canada\">Ministry of Public and Business Service Delivery of Ontario<\/a>\u00a0if the document was issued or \u201cnotarized\u201d in Ontario.\u00a0Otherwise, to be requested to\u00a0<a href=\"https:\/\/www.international.gc.ca\/gac-amc\/about-a_propos\/services\/authentication-authentification\/step-etape-1.aspx?lang=eng\">Global Affairs Canada<\/a><\/p>\n<p>Notary Public listed at this <a href=\"https:\/\/ambottawa.esteri.it\/wp-content\/uploads\/2025\/06\/Notai_Avv-05.05.25.pdf\">link\u00a0<\/a>can draw up the power of attorney directly in Italian.<\/p>\n<p>POAs in English or French must be translated into Italian.<\/p>\n<p>For translation services you may contact:<\/p>\n<ul>\n<li>ATIO (Association of Translators and Interpreters of Ontario).
